Betterlytics Terms of Service

This document is provided in multiple languages for convenience. In case of discrepancies, the English version shall prevail.

1.Scope of These Terms

1.1These Terms of Service apply exclusively to the Betterlytics hosted cloud service available at betterlytics.io and our official domains. They do not apply to self-hosted installations of our open source software. If you self-host Betterlytics, you are responsible for your own terms of service, data processing, and legal compliance.

1.2Thank you for using Betterlytics! When we say "company", "we", "our", "us", "service" or "services" in this document, we are referring to Betterlytics and our privacy-focused web analytics platform.

1.3When we say "customer", "you", "your", "yours" or "you're" in this document, we are referring to the entity, individual, or organization that signs up for Betterlytics and installs our analytics script(s) on their website(s) to use our service.

1.4We may update these Terms of Service in the future. Whenever we make significant changes to our policies, we will notify our customers via email and announce them on our website. When you use our service, now or in the future, you are agreeing to the latest Terms of Service.

1.5If you do not agree to these Terms of Service, do not use this service. Violation of any of the terms below may result in the termination of your account.

2.Account Terms

  • 2.1Security responsibility: You are responsible for maintaining the security of your account and password. Betterlytics cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • 2.2Account activity: You are responsible for any activity that occurs under your account, including activity by team members you invite to your account.
  • 2.3Legal compliance: You may not use our service for any illegal purpose or to violate any laws in your jurisdiction.
  • 2.4Registration requirements: You must provide a valid email address to complete the signup process. You must be a human - accounts registered by bots or automated methods are not permitted.
  • 2.5Website ownership: You must own or have explicit permission to install our analytics script on any website you track with Betterlytics.
  • 2.6Data accuracy: You agree to provide accurate information about your websites and not to intentionally send false or misleading data to our service.
  • 2.7Age requirements: You must be at least 18 years old to use our service. If you are between 13-17, you may use our service only with parental consent.

3.Acceptable Use

3.1Betterlytics is designed for legitimate website analytics and is built as an open source project for transparency. You agree not to use our service to:

  • Track visitors without their knowledge or in violation of privacy laws
  • Collect or process personally identifiable information (PII) unless you have a lawful basis to do so under applicable privacy laws (such as valid user consent). By default, Betterlytics is designed to avoid collecting PII. Certain optional features — such as session replay, custom identifiers, or user event tracking — or accidental inclusion of personal data in URLs, query parameters, or event payloads, may result in the collection of personal or pseudo-anonymous information. In such cases, the website owner — not Betterlytics — is the data controller and is responsible for masking, obtaining consent, and ensuring compliance with applicable privacy laws (such as GDPR or CCPA).
  • Generate artificial or bot traffic to inflate statistics or abuse our infrastructure
  • Track websites you don't own without explicit permission
  • Abuse our service infrastructure, bypass rate limits, or send malformed data that could harm our systems
  • Use our service to harm, harass, or violate the privacy of any individual
  • Violate any applicable laws, including GDPR, CCPA, or other relevant privacy/data protection laws
  • Resell, sublicense, or provide the Service (or substantial parts thereof) to third parties as a hosted analytics service without prior written consent

4.Payment, Refunds, and Plan Changes

4.1Free Tier

4.1We offer a permanently free tier with a monthly event limit as specified on our pricing page. No credit card is required for the free tier. We do not sell your data - ever, regardless of which plan you use.

4.2Billing

4.2You can use our free tier indefinitely within the monthly event limits. For higher usage, you need to upgrade to a paid plan and pay in advance. If you exceed plan limits without upgrading, you risk losing excess data. If paid accounts become overdue, we will freeze the account until payment is made.

4.3Event Limits

4.3Each plan includes a monthly limit of events (pageviews, custom events, etc.). Unused events do not roll over to the next month. You will never be charged extra for occasional traffic spikes. If you consistently exceed your plan limits for two consecutive months, we will contact you to discuss upgrading.

4.4Plan Changes

4.4You can upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrading may result in loss of features or capacity. We do not accept liability for any data loss resulting from plan downgrades.

4.5Overdue Payments

4.5If payment is overdue, we may suspend access until you settle your balance.

4.6Refunds

4.6All fees are non-refundable. However, if you experience significant service issues within the first 30 days, please contact us and we'll work with you to find a fair solution.

5.Cancellation and Termination

Important: Two Types of Cancellation
  • Subscription cancellation: Keeps your account but stops billing. Analytics data retained for 1 month.
  • Account deletion: Permanently deletes everything immediately, including all analytics data.

5.2How to Cancel

5.2You can cancel your subscription or delete your account entirely through your account settings. An email request alone is not considered proper cancellation.

5.3What Happens When You Cancel

  • 5.3.1Subscription cancellation: Your cancellation takes effect at the end of your current billing period. You won't be charged again. Your analytics data becomes inaccessible but is retained for 1 month in case you return, then permanently deleted.
  • 5.3.2Account deletion: All data (personal and analytics) is permanently deleted immediately. This cannot be undone.
  • Residual copies of deleted data may remain in encrypted backups for up to 30 days for disaster recovery purposes but will not be used or accessed.

5.4Our Right to Terminate

5.4We reserve the right to suspend or terminate your account for violation of these terms, illegal activity, or abuse of our service or team members. We will provide notice when possible, but immediate termination may be necessary in severe cases.

6.Service Modifications and Pricing

  • 6.1Service changes: We reserve the right to modify or discontinue any part of the service with or without notice. We will communicate significant changes affecting your usage in advance when possible.
  • 6.2Pricing changes: We may change our pricing structure. Existing customers are typically exempt from price increases, but we reserve the right to change prices for all customers with at least 30 days notice via email.
  • 6.3Feature updates: We regularly improve our service with new features and enhancements. Some features may require plan upgrades.
  • 6.4Beta features: Beta or experimental features may be offered for testing. These are provided without warranty and may be modified or discontinued at any time.

7.Data Ownership and Privacy

7.1Your Data Rights

7.1You own 100% of your analytics data. We claim no intellectual property rights over your website data and will never sell or share it with third parties.

7.2Anonymous Analytics

7.2By default, analytics data collected through Betterlytics is anonymized and designed to prevent the identification of individual visitors. Personally identifiable information is not collected or stored unless customers enable specific features (e.g., session replays, custom identifiers) that may involve pseudo-anonymous or personal data. We act as a data processor when handling personal or pseudo-anonymous data you provide (e.g., in features like session replays). You are the data controller and must ensure compliance with GDPR, CCPA, or other applicable data laws (e.g. obtaining consent, disclosing in your privacy policy).

7.3Data Processing Agreement

7.3For enterprise customers and GDPR compliance, our comprehensive Data Processing Agreement (DPA) is available at /dpa. The DPA forms part of these Terms of Service and governs how we process data on your behalf.

7.4Your Responsibilities

  • 7.4.1Ensure your use of our service complies with all applicable privacy laws (GDPR, CCPA, etc.)
  • 7.4.2Update your privacy policy to mention the use of Betterlytics for anonymous analytics (note: no cookie consent banner is typically required since our service is cookieless)
  • 7.4.3Do not attempt to send sensitive information (credit cards, personal data, etc.) through our service, including in URL paths or query parameters.
  • 7.4.4Maintain security of your account and immediately report any unauthorized access

7.5Our Commitments

  • 7.5.1Process your data only as described in our Privacy Policy
  • 7.5.2Implement appropriate security measures to protect your data
  • 7.5.3Never sell, share, or monetize your analytics data
  • 7.5.4Provide EU-based hosting and processing for GDPR compliance
  • 7.5.5Delete your data immediately upon account deletion

7.6Your use of Betterlytics is also governed by our Privacy Policy, which explains how we collect, process, and store data, including website visitor analytics and your account information. By using our service, you agree to the practices described in the Privacy Policy in addition to these Terms of Service.

8.Service Level and Support

8.1We strive for high availability but provide the service on an "as is" and "as available" basis. We do not guarantee uninterrupted operation or error-free performance.

8.2We may schedule maintenance; we'll endeavor to give advance notice.

8.3Technical support is provided via email on a reasonable effort basis. We aim to respond promptly but do not guarantee specific response times.

8.4We test our features extensively, but no software is perfect. We track reported bugs and prioritize fixes, especially for security or privacy issues. Not all reported bugs will be fixed immediately.

9.Liability and Disclaimers

9.1You expressly understand and agree that Betterlytics shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

  • Loss of profits, goodwill, use, data, or other intangible losses
  • The use or inability to use our services
  • Unauthorized access to or alteration of your data
  • Statements or conduct of any third party
  • Any other matter relating to these Terms or our services

What this means: While we work hard to provide reliable, privacy-focused analytics, technology isn't perfect and things can go wrong. By using Betterlytics, you understand that we can't be held responsible for any business losses or problems that might result from service issues. We're committed to earning your trust through transparency, strong security practices, and putting your privacy first.

9.3No Warranty: The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

9.4Indemnification: You agree to indemnify, defend, and hold harmless Betterlytics, its affiliates, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

9.5Force Majeure: Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of nature, power outages, internet failures, labor disputes, or government restrictions.

9.6These Terms are governed by the laws of the Kingdom of Denmark and applicable laws of the European Union.

9.7The courts of Copenhagen, Denmark have exclusive jurisdiction over disputes.

9.8Parties will first attempt to resolve issues amicably. If unresolved, disputes may be submitted to arbitration in Denmark or another mutually agreed EU forum.

9.9Our total liability shall not exceed the amount you paid in the past 12 months

10.Intellectual Property

  • 10.1Your content: You retain all rights to any content you provide to our service. Your website data remains yours.
  • 10.2Our service: We hold all IP rights in the Service, user interface, infrastructure, trademarks, and proprietary software not covered by the AGPL.
  • 10.3Feedback: If you suggest features, improvements, or feedback, you grant us a perpetual, royalty-free license to use, modify, and incorporate that feedback without obligation to you.
  • 10.4Trademarks: "Betterlytics" and our logo are our trademarks. You may not use them without written permission, except to identify our service in connection with your legitimate use.
  • 10.5Open source components: Our open source parts are licensed under AGPL-3.0; this does not extend to our hosted backend, infrastructure, or service components not included in the public repositories.

11.Updates and Communication

  • 11.1We may revise these Terms from time to time.
  • 11.2If we make material changes, we will notify you at least 30 days in advance via email.
  • 11.3Your continued use after changes take effect constitutes acceptance.
  • 11.4If you disagree, you may cancel your account before the changes take effect.
